Although recent reforms have sought to restrict the “no win, no fee” culture, it is still imperative that companies trading in the leisure industry maintain adequate cover for all aspects of their business. Due to the diverse range of trading styles and activities found within the industry, you must be on guard against both physical and legal risks.  As the general public become increasingly aware of their rights, you too must adapt to the changing landscape.

The speed and diligence of all personnel is of the essence in such situations and may be the difference between a claim being admitted or successfully defended.  If your Insurers are to defend the claim efficiently, it is imperative that certain procedures are in place and known by all staff, for example:

  •  Accident forms must be completed in their entirety, including comprehensive details of all available witnesses.
  • If CCTV cameras are in operation, understanding how to download relevant information may prove invaluable.
  • All company check lists should be retained and provided as evidence if appropriate to do so.

Please remember that a claimant has three years from the date of an incident in which to pursue the matter.
